Privacy at a glance
- For driver and employee data a carrier uploads, the carrier is the controller and Fleetive is its processor — we use that data only to run the Service.
- We do not sell your personal information or share it for cross-context advertising.
- Sensitive data such as SSNs is encrypted at rest and used only to provide the Service.
- Payments run through Stripe — Fleetive never stores full card numbers.
- Drivers: to exercise privacy rights over your data, contact your carrier (employer) — they control it.
1. Introduction and Scope
This Privacy Policy explains how Fleetive, Inc. (“Fleetive,” “we,” “us”) collects, uses, discloses, and protects Personal Information in connection with the Fleetive platform and websites (the “Service”). It applies to: (a) account holders and Authorized Users (our customers and their personnel); (b) drivers who access the Driver Portal or whose information is processed in the Service; and (c) website visitors.
Our roles. For our customers’ account, billing, and usage data, Fleetive is a business/controller. For driver, employee, and applicant Personal Information that a customer uploads or generates in the Service, the customer is the business/controller and Fleetive acts as a service provider/processor, processing that information on the customer’s behalf and instructions.
Drivers and employees: if you have questions about how your information is used, please contact the motor carrier (your employer or prospective employer) that uses Fleetive; they control that data.
2. Information We Collect
2.1 Information you provide
- Account & profile: name, business name, work email, phone, role, and DOT/MC identifiers.
- Billing: subscription plan and billing details. Payment-card data is collected and processed by Stripe; Fleetive does not store full card numbers.
- Customer Data you upload, which may include sensitive Personal Information about your drivers, employees, and applicants — for example: name, Social Security number / Tax ID, date of birth, address and residence history, driver’s license / CDL data, employment and accident/violation history, medical-certification and qualification documents, signatures, and FMCSA driver-qualification (Part 391) information.
- Vehicle/asset data: VINs, unit numbers, registration, maintenance, and compliance documents.
- Communications: messages, support requests, and feedback.
2.2 Information collected automatically
Device and usage data, log data, IP address, approximate location derived from IP, browser/OS, and diagnostic/error data, and information from cookies and similar technologies (see the Cookie Policy).
2.3 Information from third parties
Payment and subscription status from our payment processor (Stripe), and FMCSA/SAFER and government/VIN data retrieved at your direction.
3. How We Use Information
We use Personal Information to: (a) provide, operate, secure, and maintain the Service; (b) authenticate users and manage roles, accounts, and the Driver Portal; (c) process subscriptions, billing, and payments (via Stripe); (d) generate the features you use (e.g., compliance organization, alerts, settlements) as a tool, not as a compliance determination; (e) provide support and communicate with you (service, security, billing, and workflow messages); (f) monitor, debug, and improve the Service and develop aggregated/de-identified analytics; (g) detect, prevent, and respond to fraud, abuse, and security incidents; and (h) comply with law and enforce our agreements. We do not use driver/employee Personal Information for our own independent purposes; we process it on the customer’s behalf to provide the Service.
4. Legal Bases (where applicable)
Where data-protection law requires a legal basis, we rely on performance of a contract, our and our customers’ legitimate interests (operating and securing the Service), consent (where required, e.g., certain cookies or SMS), and compliance with legal obligations.
6. Drivers and Employees
If you are a driver or employee whose information is in the Service, the motor carrier that engages you is the controller of that information and determines how it is used. Fleetive processes it on the carrier’s behalf. To access, correct, or delete your information, or to exercise privacy rights, contact the carrier directly; we will support the carrier in responding to such requests as required by law and our agreement.
8. Data Security
We maintain reasonable administrative, technical, and physical safeguards, including encryption in transit (TLS), encryption at rest of designated sensitive fields (such as Social Security numbers), role-based access controls, audit logging, and least-privilege access. No system is perfectly secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your Personal Information, we will notify affected parties as required by applicable law; for driver/employee data, we will notify the relevant customer (controller).
9. Data Retention and Deletion
We retain Personal Information for as long as needed to provide the Service and for legitimate business, legal, audit-trail, tax, and security purposes. Because the Service supports DOT recordkeeping and audit integrity, certain records are retained (including through soft-deletion) and are not immediately or permanently erased on a delete action. Upon account termination, Customer Data is handled as described in the Terms. Customers (as controllers) are responsible for retaining records they are legally required to keep.
10. Your Privacy Rights
Depending on where you live and applicable law (e.g., the California Consumer Privacy Act as amended by the CPRA, and similar laws in Virginia, Colorado, Connecticut, Utah, Texas, and other states), you may have rights to know, access, correct, delete, obtain a portable copy of, and limit certain uses of your Personal Information, and to be free from discrimination for exercising these rights. We do not sell or share Personal Information for cross-context behavioral advertising, and we do not use sensitive Personal Information (such as SSNs) except to perform the Service. To exercise rights for data we control, contact privacy@fleetiveapp.com; we will verify your request as required by law. For driver/employee data we process for a customer, please contact that customer (controller); we will assist them as required.
11. International Users
The Service is operated from the United States and intended for U.S. motor carriers. If you access it from outside the U.S., you understand your information will be processed in the U.S. under U.S. law.
12. Children’s Privacy
The Service is not directed to, and we do not knowingly collect Personal Information from, individuals under 18. If you believe a minor’s information has been provided, contact privacy@fleetiveapp.com.
13. Third-Party Links and Services
The Service may link to or integrate with third-party services governed by their own privacy policies; we are not responsible for their practices.
14. Changes to This Policy
We may update this Policy and will post the revised version with a new “Last updated” date and provide notice of material changes as required by law.
